CPS wants to incriminate my family for something that happened 9 1/2 years ago can they do that?

And this was before my niece was even born, my brother got a harment charge after he left high school, and a few years later he had a daughter, so now can then take his daughter away for something so long ago i need proof to send to our Social Worker, lots of help would be great!!!
